Information on Trademark Registration in Iran

 
Iran with more than 80 million of population is the second largest country in the Middle East and it is a large market for many foreign companies.
Many foreign companies involve a wide range of business activities such as operation, marketing, production, export goods and services, so on in Iran especially in Tehran that is the capital of this country. So Iran is a very important area for many companies which are interested in business with Iranian companies or their representatives. Even the companies that are not active in Iran intend to register their trademark, patents or industrial design and be protected by Iranian laws. 
 
Here in this article there is some useful information you would like to know on trademark registration in Iran.
Procedure of registration.
 
According to law of “registration of patents, industrial designs and trademarks” (passed on 2007) everyone who first registers a trademark can exclusively use the mark. A trademark can be registered by a natural person or a legal person (corporation). 
The applicant should file his trademark application via website www.iripo.ssaa.ir together with a reproduction of the trademark and a list of goods or services for which registration is requested which are under Nice classification. The prescribed fees also should be paid by the applicant. If the priority is claimed the certified document should be submitted within 2 months from filing the application. 
For the foreign applicants it is necessary to perform the process through an agent.
 
Timeframe for examination 
The application takes approximately 5-7 months from filing to registration. If it is verified, the application is published in the official gazette for everybody who may oppose within 30 days. Then the grant fee should be paid and the registration is published in the official gazette and the certificate of trademark registration is granted by the trademark office. 
 
Multiple classes
Multiple classes in one application are acceptable by Iranian trademark law. 
Protection period and renewal
The trademark is protected for 10 years from the application date and the owner can renew it every 10 years. After the expiration of a trademark registration term, a trademark holder may be granted a six-month extension term for the renewal by payment of a surcharge.

Required documents for trademark registration

  1.   A power of attorney signed by the applicant & in the case of corporate body, by the Director Legal representative of the company; It should be certified and legalized by the Iranian Consulate; 
  2.  The full name and address of the applicant and type of its activity;  An original executed Power of Attorney;
  3.   A sample of the mark; for three-dimensional marks, the applicant must provide sufficient dimensions of the mark to be clearly represented (front, top and side picture of a 3D mark with label, if 3D trademark is to be filed in Iran).
  4.  Description of colors (if color trademark is to be filed in Iran),
  5.  List of goods and/or services and related classes (according to the International classification),
  6.  A certified copy of the Certificate of Incorporation of the applicant company;
  7.  If claiming priority, a certified copy of the priority document. (Priority under the Paris convention can now be claimed in Iran. Details of Convention priority, if any first filed country, filing number and date)
